Division of Marital Property
Texas is a community property state, but that doesn’t always mean that assets and liabilities you accumulated during your marriage are divided 50/50. It depends on your specific situation and what the court decides. Any property you had before you got married is your separate property. Child Support and Modifications
Typically, the parent who doesn’t see the child for the majority of the time or provide the primary residence for the child will pay child support. The court will look at your monthly gross income and the number of children you’re supporting to determine what your monthly payment will be. For instance, if you have one child, you’ll pay 20% of your monthly net resources, and if you have two, you’ll pay 25% of your monthly net resources. Net resources is not the same as net income. Our Fort Bend County divorce lawyers will advise you to always make your payments on time, or else you could get into severe legal trouble with the court and face significant repercussions.
If you cannot pay because you lost income, you should still pay as much as you can and get in touch with your family lawyer ASAP. You can then request a child support modification with the court to change your monthly payment.
Spousal Maintenance
In Texas, the longer you are married, the longer you may have to pay spousal maintenance. The only exception is if there was any family violence. For instance, if you were married less than 10 years but there was family violence, you could pay for no more than five years – which is the same amount of time if you were married 10+ years and there was no family violence. Prenups and Postnups
If you want to protect your property that’s in your name – and not your future spouse’s – you can get a prenup before you get married. You need to make sure that your prenup is valid, and the way to do that is by hiring the right family lawyer.
