On June 25, 2015, the Supreme Court of the United States made the monumental decision to make same-sex marriages legal in all fifty states with their ruling in Obergefell v. Hodges. In addition to granting the LGBTQ community greater constitutional rights, it also gave rise to a host of family law issues, including those relating to divorce, parental rights, and child custody of same-sex parents. 

For instance, many same-sex couples mistakenly believe being legally married means the non-biological parent will be recognized as the presumptive parent of any child(ren) born during their marriage. While this may be true in some states, it is not true in Texas. In order to fully protect the parent-child relationship in Texas, the non-biological parent in a same-sex marriage must legally adopt his/her child(ren).
