LGBTQ Family Law Issues
Family Lawyers Serving Houston's LGBTQ Community Since 2003
On June 25, 2015, the Supreme Court of the United States made the monumental decision to make same-sex marriages legal in all fifty states with their ruling in Obergefell v. Hodges. In addition to granting the LGBTQ community greater constitutional rights, it also gave rise to a host of family law issues, including those relating to divorce, parental rights, and child custody of same-sex parents.
For instance, many same-sex couples mistakenly believe being legally married means the non-biological parent will be recognized as the presumptive parent of any child(ren) born during their marriage. While this may be true in some states, it is not true in Texas. In order to fully protect the parent-child relationship in Texas, the non-biological parent in a same-sex marriage must legally adopt his/her child(ren).
Our lawyers can help guide you through the legal processes necessary to achieve a sense of security that your family has the same legal rights and protections enjoyed by opposite-sex married couples.
Legal Counsel For Your LGBTQ Issue
Even the most amicable family law matters can be stressful and exhausting. The volatile debates centered on marriage equality can make a same-sex divorce even more taxing. Whether it’s a pre-nup, post-nup, cohabitation agreement, child custody, divorce, or any other family law related issue, you must know your rights and be well-advised by experienced firm whose lawyers are members and allies of the LGBTQ community.
